Pre-Order Terms and Conditions
These Pre-Order Terms and Conditions ("Terms") govern the placing of pre-orders ("Pre-Order") with Big B Comics Hamilton ("we", "us", or "our"). Please read these Terms carefully before submitting your Pre-Order. By submitting your Pre-Order, you agree to be legally bound by these Terms.
1. Pre-Order Reservation:
1.1. By placing a Pre-Order, you are reserving the right to purchase the specified product(s) before they are available for general sale to the public.
1.2. Pre-Orders are subject to availability and may be limited or discontinued at any time at our discretion.
2. Pre-Order Process:
2.1. To place a Pre-Order, you must provide valid and accurate information, including your name, shipping address, email address, and payment details.
2.2. You will be charged the full amount of the Pre-Order at the time of placing the order.
2.3. Pre-Orders are processed on a first-come, first-served basis. Placing a Pre-Order does not guarantee the availability of the product.
3. Product Availability:
3.1. The estimated availability date of the product(s) will be communicated to you as soon as it is provided to us. However, this date is subject to change, and we do not guarantee the exact delivery date.
3.2. We will notify you of any delays or changes to the estimated availability date as soon as possible.
4. Order Cancellation:
4.1. Cancellation of pre-orders is not allowed once the order has been submitted and paid nor can it be exchanged for other items or services being rendered. All pre-orders made are considered sold.
5. Pricing and Payment:
5.1. The price of the product(s) is as stated at the time of placing the Pre-Order and is inclusive of any applicable taxes.
5.2. We reserve the right to change the price of the product(s) at any time, but such changes will not affect Pre-Orders that have already been confirmed.
5.3. Payment for Pre-Orders must be made in full at the time of placing the order.
6. Shipping and Delivery:
6.1. Shipping costs and delivery times will vary depending on your location and the shipping method selected.
6.2. We will make reasonable efforts to deliver the product(s) to you by the estimated availability date. However, we are not responsible for any delays or failures in delivery caused by events beyond our control.
7. Limitation of Liability:
7.1. To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your Pre-Order or the product(s), including but not limited to loss of profits, loss of data, or loss of use.
7.2. Our total liability for any claim arising out of or relating to your Pre-Order or the product(s) shall not exceed the total amount paid by you for the Pre-Order.
8. Changes to Terms:
8.1. We reserve the right to update or modify these Terms at any time without prior notice.
8.2. Any changes to these Terms will be effective immediately upon posting on our website. It is your responsibility to review these Terms periodically for changes.
